These Terms are an agreement between you and Gibaway LLC ("Gibaway," "we," "us," or "our"), the operator and sponsor of Gibaway's initial U.S. launch giveaways.
Each giveaway can also have its own official rules, eligibility criteria, shipping disclosures, claim windows, and platform-specific requirements. If a giveaway page or official rules are more specific than these Terms, the giveaway-specific rules control for that giveaway.

1. Agreement to the Terms
By creating an account, entering a giveaway, accepting an updated version of these Terms, or otherwise using Gibaway, you agree to these Terms and any giveaway-specific official rules that apply to a campaign.
2. Eligibility and U.S. launch scope
- Gibaway launches first for U.S.-based use and U.S. shipping flows.
- You must be at least 18 years old, or the age of majority where you live if higher.
- You may only use Gibaway if you can form a binding contract and your use is lawful.
3. Accounts and security
You are responsible for the accuracy of your account details and for all activity under your account. Keep your password and linked social access secure. Do not share accounts, impersonate others, or use Gibaway to falsify giveaway eligibility or social verification.
4. Supporter accounts and giveaway entry
Supporter accounts help you find giveaways, follow profiles, receive optional notifications, confirm campaign-specific eligibility, enter eligible giveaways, and track a winning claim from selection through delivery. No purchase is necessary to enter a launch giveaway, and no paid plan improves the odds of winning.
Where law, platform policy, or official rules require a free AMOE path, that method remains available and controls.
5. Gibaway-sponsored launch giveaways
During the initial public launch, only authorized Gibaway staff may create, publish, administer, draw, or fulfill giveaways. Each public giveaway must be sponsored by Gibaway, have its prize secured before publication, and include campaign-specific official rules. Gibaway is responsible for the promised prize and standard U.S. delivery to an eligible winner who completes the claim process on time. Winners are not charged for the prize or standard shipping.
Public creator self-service, user-funded prize campaigns, and prize-money custody or escrow are not available at launch. Gibaway may offer those services later only with additional safeguards, disclosures, eligibility review, payment terms, and any legally required custody or escrow structure.
6. Linked social accounts and verification
Gibaway may let supporters and creators link supported social accounts so we can verify relationships such as follows, subscriptions, or other supported eligibility checks. Your use of YouTube, TikTok, Instagram, Threads, Twitch, Discord, X, Apple, Stripe, and other third-party services remains subject to their own terms and policies.
7. Paid plans, recurring billing, and cancellation
Gibaway may offer consumer plans or other paid services in the future. If you start a paid plan, you authorize us and our payment processors to charge the payment method you provide for the amounts, intervals, and taxes disclosed at checkout.
- Recurring subscriptions renew automatically until canceled.
- You can cancel future renewals from the billing area or another cancellation path we provide.
- Unless we expressly say otherwise, cancellations stop future renewals and do not retroactively refund completed billing periods.
- Pricing, creator fees, and included features may change prospectively with notice.
Any label credits visible to authorized staff are prepaid, non-transferable Gibaway service credits used only for USPS postage and disclosed label fees. They are not cash, a deposit account, a bank account, or an escrow account; they cannot be transferred between users or withdrawn as cash. Gibaway reserves the quoted amount while a label is generated, settles the actual disclosed total, and releases unused or failed reservations.
8. Payment methods, shipping, and claims
For initial public launch giveaways, Gibaway pays standard U.S. shipping and controls fulfillment. Winners must provide or confirm an accurate eligible shipping address within the posted claim window. Gibaway does not charge a winner for a prize or standard delivery and does not use a saved payment method for an unrelated charge.
9. Transparency and winner selection
Gibaway may display entry criteria, verification checks, claim deadlines, shipping status, and winner-selection details so giveaway outcomes are easier to understand and review. We may retain audit records and verification data to investigate abuse, disputes, or moderation issues.
10. Prohibited conduct
- No fraud, spam, bots, or attempts to manipulate eligibility or winner selection.
- No misuse of linked-platform permissions or attempts to impersonate supporters, creators, staff, or admins.
- No unlawful, deceptive, abusive, infringing, or harmful content, promotions, or prize claims.
11. Suspension, termination, and service changes
We may suspend, limit, or terminate accounts; remove giveaways; reject creator applications; or disable linked platform access when necessary for safety, legal compliance, billing enforcement, or platform integrity.
12. Disclaimers and limitation of liability
Gibaway is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee uninterrupted service, successful creator approval, successful third-party platform verification, or that any user will win a giveaway or receive a prize by a particular date.
To the fullest extent permitted by law, Gibaway and its service providers are not liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service.
13. Governing law and disputes
These Terms are governed by the laws of Florida, except where federal law or consumer-protection law requires otherwise. Before filing a formal claim, you agree to give us written notice of the dispute and try to resolve it informally for at least 30 days.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we may post the revised Terms, update the effective date, and ask you to accept the updated Terms before continuing to use certain features.
